| Justice Ministry: 2004 Constitutional Amendments Implemented With Procedural Violations |

The FINANCIAL -- The Justice Ministry believes that the relevant procedures were violated during amendment of the Ukrainian Constitution in 2004.
Justice Minister Oleksandr Lavrynovych announced this at a news briefing.
«It is obvious that the procedures that are stipulated in the Constitution regarding mandatory constitutional control over every provision that is proposed to the Basic Law was violated during adoption of the 2004 amendments,» he said.
According to Lavrynovych, the Constitutional Court, which is presently considering a petition from parliamentary deputies to assess the 2004 constitutional amendments, has asked the Cabinet of Ministers to present its arguments regarding the 2004 constitutional amendments and the Justice Ministry has presented its arguments to the Cabinet of Ministers.
«Since the Constitution of Ukraine provides for special constitutional control over the process of amendment of the Basic Law, observance of this procedure is mandatory to ensure that the norms are valid,» Lavrynovych said.
He explained that the presiding judge should ask for the views of the parliament, the Cabinet of Ministers, the president, and scientific institutions during consideration of this petition to enable it to take all viewpoints into account.
As Ukrainian News earlier reported, President Viktor Yanukovych said in his address to the nation on Ukraine ’s 19th independence anniversary on August 24 that it was necessary to improve the Constitution.
On July 13, 252 parliamentary deputies petitioned the Constitutional Court to consider the constitutionality of the law No. 2222-IV of December 8, 2004, entitled «On Amendments to the Constitution of Ukraine .»
